Right of Withdrawal

If you are a consumer, you have a statutory right of withdrawal when purchasing a license for the "One View Player" application from Company Name Ltd. via http://oneviewplayer.berkcan.tr. Please read the following information carefully, in particular the section on the expiry of the right of withdrawal for digital content.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (Company Name Ltd., Street 1, 00000 City, Country, e-mail: hello@berkcan.tr, telephone: +00 000 000 000) of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an e-mail). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement by bank transfer to the account from which you paid, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. Please state your order number in your withdrawal so that we can assign it.

Expiry of the right of withdrawal for digital content

Your right of withdrawal expires once we have begun performance of the contract, that is once the license has been activated on your device, if you have given your express prior consent to the start of performance before the end of the withdrawal period, have acknowledged that you thereby lose your right of withdrawal, and we have provided you with a confirmation of this on a durable medium.

You give this consent and acknowledgement by ticking the corresponding checkbox during checkout. The confirmation on a durable medium is contained in the activation e-mail we send you. Before the license has been activated you can withdraw from your order at any time and receive a full refund of any amount already paid.

Voluntary goodwill refund

Irrespective of the statutory right of withdrawal, and without limiting your statutory rights regarding conformity, we offer the following voluntary goodwill policy:

• If the App cannot run on your device because of a defect in the App that we are unable to fix, we will refund the purchase price on request within 14 days of activation. Please send your order number and device ID to support@berkcan.tr.
• As an alternative, you can move the license to another device ID in your account (subject to the limit of 3 moves per 12 months).
• No goodwill refund is granted for problems caused by playlists, playlist providers, streams or your network or internet connection.

We therefore recommend that you use the free trial of 7 days to test the App with your device and playlists before purchasing.
